After the required documents are completed, The Turkish Patent Institute (TPI) examines the application. The TPI undertakes formal examination of the application regarding the number, the views, the dimensions and the clarity of the representations submitted. An industrial design must be novel and distinctive in order to be protected. If the application derives priority from an application already registered in a state party to the Paris Convention, the particulars of the priority application are examined based on the certified copy of the priority document.
After the examination is completed, publication period begins. The applicant may request the postponement of the publication for up to thirty months. Natural and legal persons may oppose to the registration of a design application within six months.
If there is no opposition during the publication period, the TPI decides to the registration and sends Industrial Design Registration Certificate within two months after the publication term is expired. Industrial design registration is valid for five years and renewable for every five years, up to 25 years in total.
Registration process is completed between 10-12 months.
